However, Milner, who linked up at the Amex Stadium in a free transfer in 2023, will now remain with the Seagulls through to the end of next season.
Reflecting on the decision to extend the former England international's stay, Brighton boss Fabian Hurzeler said: "I’m really pleased we will have James with us again this season.
"Last season he wasn’t able to help the team on the pitch as much as he would have liked.
"But around the squad his experience is invaluable, especially for the younger players.
"He’s a great guy to have in our environment, who is always there for me and the team.
I’m looking forward to working with him again."
The new deal means he is now set to join an exclusive group of players during the upcoming campaign.
Milner will become only the fifth outfield player to feature in the Premier League aged 40 or older.
The 39-year-old turns 40 on January 4, allowing him to join Teddy Sheringham, Ryan Giggs, Kevin Phillips and Gordon Strachan to have done so.

He could also end the season as the third oldest outfield player in Premier League history behind Sheringham and Giggs.
Milner will be 40 years and 140 days old on the final day of the season on May 24.

The three-time Premier League winner is also on the cusp of becoming the division's all-time leading appearance maker.
He currently sits second behind Gareth Barry with 638 career top-flight appearances for Liverpool, Manchester City, Aston Villa, Newcastle, Leeds and Brighton.
In those matches, Milner has scored 55 goals and provided a further 86 assists.
Ahead of the 2025/26 season, the veteran needs just 15 more appearances to equal Barry's record of 653 matches.
It comes after he was limited to just four league outings last term.
Milner missed almost the entirety of the campaign with a knee injury, which ruled him out from August until May.

He made his long-awaited return to action on the final day as Brighton won 4-1 at Tottenham.
That win was enough to secure an eighth place finish in Hurzeler's first season in charge.
